Refused under 221(g) email translation and explanation


The following email response is recieved when applicants send inquiry emails regarding their SIV case after they have completed their visa interview. Often times the Afghan applicants start panicking and mistakenly think their case has been denied without fully understanding the email message and context. The confusion arises when applicants only focus their attention to the following sentence: “your special immigrant visa case was refused under 221(g) of the Immigration and Nationality Act (INA)“.

So what it means?

It means that your case has not been denied or refused, but that your case wasn’t issued visa on interview day due to requirement of completing the “Administrative Process” first and the applicant must patiently wait for the administrative processing to finish before getting either drop-off or visa issued.


So whats next? What can you do?

While your SIV application is under administrative processing, it is very important to regularly open and check your DS-260 application status to make sure it always shows “complete” status. Often times, the SIV cases are delayed due to DS-260 application going into “re-opened” or “incomplete” status.

We have reviewed Department records and can confirm that your special immigrant visa case was refused under 221(g) of the Immigration and Nationality Act (INA), pending administrative processing in order to verify your qualifications for this visa. We will notify the applicant when this process has completed and the application is ready to move forward.

When administrative processing is required, the timing will vary based on individual circumstances of each case, however, please note that this is an essential part of the application that can neither be waived nor expedited. We realize that these extended time periods can cause frustration and recognize the threats that many applicants now face because of their work with the U.S. government. Unfortunately we cannot predict when the administrative processing will be concluded.
